Οι συμβάσεις εμπιστευτικότητας είναι ευρέως διαδεδομένες στις Η.Π.Α. και γνωστές ως NDAs (Non- Disclosure Agreements) και αποτελούν ένα από τα βασικά εργαλεία των startup εταιρειών. Στην Ελλάδα, οι συμβάσεις αυτές υπάρχουν στην επιχειρηματική κουλτούρα μεγαλύτερων εταιρειών, ωστόσο δεν ισχύει το ίδιο και στην περίπτωση των startup εταιρειών.

Τι είναι όμως η συμβάση εμπιστευτικότητας;

Η σύμβαση εμπιστευτικότητας ή αλλιώς συμφωνητικό εχεμύθειας είναι η μονομερής ή αμοιβαία σύμβαση με την οποία οι Συμβαλλόμενοι αναλαμβάνουν την υποχρέωση τήρησης απόλυτης εχεμύθειας για όλες τις εμπιστευτικές πληροφορίες που τους έχουν παρασχεθεί ή θα τους παρασχεθούν στο μέλλον, καθώς και για όλες τις πληροφορίες στις οποίες δίνεται πρόσβαση λόγω της ιδιότητας ή της συνεργασίας τους.
